In a recent verdict, the Osun State High Court in Osogbo has sentenced Wasiu Afolayan (36) and Kola Adeyemi (34) to death by hanging for their involvement in multiple cases of conspiracy and armed robbery.
The presiding judge, Ayo Oyebiyi, delivered the verdict after determining that the defendants, identified as serial robbers, were responsible for numerous robbery incidents across the Osogbo metropolis.
The charges against Afolayan and Adeyemi included conspiracy, armed robbery, and unlawful possession of arms, as stipulated under Section 3(1) of the Robbery and Firearms (special provisions) Act, Cap R.11, Laws of Federation of Nigeria, 2004. Despite pleading not guilty, the defendants were found guilty during the trial.
According to the prosecutor, Mr. Bewaji Adeniji, the defendants committed robbery near C.A.C No. 16, Oke-Onitea Area, Osogbo, on December 7, 2018, and were also involved in a separate incident on November 26, 2018, at No. 3, Oduola Street, Igbona Area, Osogbo, where they fatally shot one Olaniyi Adewale.
During the trial, Adeniji presented six witnesses and various exhibits, including the defendants' extra-judicial statements from both the Divisional Police Headquarters and the State Criminal Investigation Department (SCID) in Osun Command Headquarters.
While the defense counsel, Mr. Ayodele Olaniyan, pleaded for leniency, emphasizing that his clients were first-time offenders, Justice Oyebiyi ruled that the prosecution had sufficiently proven the charges beyond reasonable doubt. Consequently, he sentenced Afolayan and Adeyemi to death by hanging for their involvement in armed robbery.
